So a little while back im cycling home from the pub along hackney grove (you know, that stupid cycle path alley from london fields to the town hall) and at the crossing on Martello st some stupid, blind fucking ped (who i have in writing as admitting to drinking earlier himself) steps out infront of me. So i hit him at 20 odd n he goes to hospital, im left collecting the pieces of my ltd edition carbon saddle n checking my scratches.
Now i get a sumons for "careless cycleing"/"riding without due care and attention".
Do i just put in a written plea of guilty and pay the £70 costs and hope it goes away and i dont get sued for double jepordy (if thats applicable) or do i fight it and counter sue whoever (the guy i hit/police) for loss of earning (the time i spend in court), the damage to my bike, my injuries and the mental anguish caused by this whole heap of bollox. The latter of course running the risk of them actually finding me guilty through some technicality and making me pay a whole heap more costs.
am not a lawyer but i would check a few basics first like a)assuming it was dark did u had lights on? b) did you jump on any red lights? if there were any lights at all. c) were there any witnesses to the scene? (in order to back up/prove ur side of story) d)were u on a cycling path/street or on the pavement? was it at a zebra crossing or at a random stretch of the street? e) u weren't drunk right? .i think the speed limit in town is 30 mph let alone u r a pushbike i.e no engine no speedometer no way of telling how fast u were going anyways.
a) any possable lack of lights has not been mentioned in the statements. however there may be cctv. b) there were no traffic lights and i believe the cycle path has right of way there (ide have to double check) c)there were witnesses but they are friends of the other guy d)it was a cycle path crossing a road and pavement e) the police statement says i could have been drunk, difficult to tell with all the stress and adrenalin and possable tiredness due to the time of day. It was said that even though i wasnt breaking a speed limit i was travelling at an "unsafe" speed specially considering the junction.
theres not that much in my favour there eh... i need to speak to a solicitor i think. can anyone recomend one that deals with traffic law and accepts legal aid clients?
